Free Trial Membership Terms and Conditions

Application of Terms and Conditions

These terms and conditions (Terms and Conditions) apply to the 2-month free trial membership (Free Trial Membership) being offered by the Chamber of Commerce and Industry of Western Australia Limited (CCIWA).

All members agree to be bound by and comply with, CCIWA’s constitution (the Constitution), by-laws, the rules and regulations of the Board and/or Council (as appropriate) and these Terms and Conditions, as amended or varied, from time to time.

Free Trial Membership Eligibility

To be eligible to subscribe to the Free Trial Membership you must:

  1. be a small to medium enterprise with less than 100 FTE staff and have either:
    • never been a member of CCIWA; or
    • not been a member of CCIWA in the last 5 years; and
  2. elect to subscribe to the Free Trial Membership on or before 31 August, 2020.

Membership Term

Your Free Trial Membership begins on the date that you join CCIWA and ends on the 2 month anniversary of joining (Free Membership Term).

On completion of your Free Membership Term, you may elect to either:

  • continue your membership with CCIWA and to subscribe to one of CCI’s membership packages being offered; or
  • discontinue your membership with CCIWA.

CCIWA Membership Packages

Details of CCIWA membership packages are provided on our website and are subject to change, variation or cancellation at any time.

CCIWA makes no representation or promise that the services offered at the time of joining CCIWA or renewal of membership (if applicable) will continue to be provided to members.

Fees

No Membership fees are payable for the Free Trial Membership.

Any fees paid to CCIWA for service during the Free Membership Term (for example, Consulting, Training, Events and/or Subscriptions as discussed further below) will not be refunded for any reason.

Free Trial Membership Benefits

CCIWA provides its members with a range of services and benefits as part of its Free Trial Membership. The benefits offered under the Free Trial Membership (and a comparison to other membership packages currently offered by CCIWA) are set out in Annexure A.

For the avoidance of any doubt, the following restrictions will apply in relation to the Free Trial Membership:

Limited to 3 calls during the Free Membership Term.

For a member discount or member rate to apply, the CCIWA service must be incurred and/or paid for in full during the Free Membership Term.

Consulting – All advisory work performed by CCIWA staff during the Free Membership Term will attract the member discount. Any work completed outside the Free Membership Term (regardless if instructions were received during the Free Membership Term) will incur the non-member rates.

Training – All training courses registered and paid for during the Free Membership Term (regardless if the training course is to be held on a date outside the Free Membership Term) will incur the member discount.

Events – All events registered and paid for during the Free Membership Term (regardless if the event is to be held on a date outside the Free Membership Term) will incur the member discount.

Subscriptions – All CCIWA publication subscriptions paid for during the Free Membership Term will incur the member discount. For example, if you purchase a subscription for a 12-month period and you pay for that 12-month subscription in full during the Free Membership Term, the member discount will apply. Any payments made outside the Free Membership Term will incur the non-member rates.

General

Changes to Terms and Conditions

From time to time, CCIWA may update these Terms and Conditions. The updated Terms and Conditions will apply to all Free Trial Membership applications from the time of posting on our website and onwards.

Inconsistency

In the event of any inconsistency between these Terms and Conditions and the Constitution, the Constitution prevails.

Severability

Any provision of, or the application of any provision of, these Terms and Conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or other jurisdiction.

Governing Law

These Terms and Conditions are governed by the laws of Western Australia.  Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Western Australia.

Transferability

Membership, and the rights of being a CCIWA Member, are personal to the member and are not transferable.
