Terms and Conditions – Three Free Offers, Free Trial Membership and 15% Discount Membership Fees

These terms and conditions (Terms and Conditions) apply to the following membership campaigns currently being offered by Chamber of Commerce and Industry of Western Australia Limited (CCIWA):

  • Free Offers for the WA business community, being:
    • Respect@Work Gap Analysis;
    • Employment Relations Advice; and
    • Employment Contracts and HR Documents “Red Flag” Review,
      (together, Three Free Offers)
  • Free Trial Membership until 30 May 2025 (Free Trial Membership); and
  • 15% Discount to Membership Fees (if membership fees are paid before 30 June 2025) (15% Discount Membership).

All CCIWA members (Members) agree to be bound by and comply with CCIWA’s Constitution (the Constitution), by-laws, the rules and regulations of the Board and/or Council (as appropriate) and these Terms and Conditions, as amended or varied, from time to time.

As a company limited by guarantee, Members provide a guarantee under the Constitution in the event of a winding-up. The guarantee is limited to the membership fee, as detailed in your membership application form.

Free Trial Membership

Free Trial Membership Eligibility

To be eligible to subscribe to the Free Trial Membership you must:

  • be a small to medium enterprise with less than 100 FTE staff and have not been a member of CCIWA in the last 12 months;
  • elect to subscribe to the Free Trial Membership between 1 April 2025 and 30 May 2025; and
  • upon a CCIWA representative making contact shortly after joining CCIWA, provide credit card details to CCIWA for the payment of ongoing Membership fees (if any).

Free Membership Term

Your Free Trial Membership begins on the date that you join CCIWA (Joining Date) and ends on 30 May 2025 (Free Membership Term).

Membership Fees

No Membership Fees are payable for the Free Trial Membership.

Free Trial Membership Services

Exclusive Free IR Consultation

During the Free Membership Term, you will have exclusive access to a free IR consultation session (Free IR Consultation). A qualified legal practitioner from CCIWA’s wholly owned subsidiary, Business Law Western Australia Pty Ltd, will be able to assist you (in person or on-line) with practical insights on new workplace laws, helping you avoid costly compliance risks.

A CCIWA representative will contact you via phone within one to two business days of the Joining Date to organise the Free IR Consultation.

The provision of the Free IR Consultation will be subject to internal resourcing and individual availability and will at all times be at the absolute discretion of CCIWA.

Benefits and Services

During the Free Membership Term, you have the same benefits and services as listed on CCIWA’s website applicable the relevant tier of CCIWA Membership, subject to the following changes in relation to the Essential and Complete membership packages:

  1. unlimited access to the Employee Relations Advice Centre;
  2. unlimited access to the Workplace Health and Safety Advice Line; and
  3. access to the Grant Finder portal for 1 or 2 users (as the case may be),

is deleted and replaced with:

  1. access to the Employee Relations Advice Centre and/or Workplace Health and Safety Advice line is limited to complimentary phone calls in relation to three (3) separate employment / workplace issues only.

The provision of such services and benefits is at all times at the absolute discretion of CCIWA and is subject to change, variation or cancellation at any time.

Member Discounts

Member discounts for CCIWA consulting services are not available during the Free Trial Membership and will only become available when you join as a paying member.

“Red Flag” review

For the purposes of the Free Employment Contract and HR Document “Red Flag” Review (see above), you will only be eligible to receive one (1) Red Flag Review during the Free Trial Membership.

You will be eligible to receive three (3) separate Red Flag Reviews (during a 12-month period) when you join as a paying member.

Provision of credit card details

A CCIWA representative will contact you via phone within one to two business days of the Joining Date. To continue to be eligible to subscribe to the Free Trial Membership, you must provide credit card details to CCIWA for the payment of applicable ongoing Membership Fees (if any).

At this time, you will be asked to elect whether you wish to pay ongoing Membership Fees on an annual basis or in monthly instalments (as applicable).

If you do not provide credit card details to CCIWA at this time, access to CCIWA membership services and benefits under the Free Trial Membership will be terminated immediately.

Automatic Roll-over to CCIWA Membership

You must notify CCIWA by calling the CCIWA membership team on 1300 422 492 during business hours (being, 8am – 5pm (WST) Monday to Friday) or via email to [email protected] before the end of the Free Membership Term (ie before 30 May 2025) if you wish to discontinue your membership with CCIWA (Notice to Discontinue).

If CCIWA does not receive a Notice to Discontinue, your Free Trial Membership will automatically roll over into a paid annual or monthly (as elected) CCIWA membership package on completion of your Free Membership Term.

If you pay your annual or monthly Membership Fees (as applicable) and funds have been received by CCIWA on or prior to 30 June 2025, you will be eligible for a 15% discount to your Membership Fees (see below).

15% Discount to CCIWA Membership

To be eligible to subscribe to the 15% discount on CCIWA Membership you:

  • must:
    • have elected to subscribe to the Free Trial Membership and have not provided a Notice to Discontinue to CCIWA; or
    • not currently be a member of CCIWA; or
    • not have been a member of CCIWA in the last 12 months; and
  • must elect to subscribe to the 15% discount on CCIWA Memberships (and payment is received by CCIWA) on or before 30 June 2025.

The 15% discount offer on CCIWA Memberships applies to each tier of CCIWA Memberships.

Advantage and Corporate Members must pay their Membership Fees on an annual basis. Entry, Essential and Complete Members will have the option to pay their Membership Fees on an annual basis or in monthly instalments.

CCIWA Membership Terms and Conditions

Other than as set out above, all other terms and conditions of CCIWA membership remain in full force and effect. The membership terms and conditions can be found on CCIWA’s website at Membership Terms and Conditions — CCIWA.

General

Changes to Terms and Conditions

From time to time, CCIWA may update these Terms and Conditions. The updated Terms and Conditions will apply to this referral campaign from the time of posting on our website and onwards.

Inconsistency

In the event of any inconsistency between these Terms and Conditions and the Constitution, the Constitution prevails.

Severability

Any provision of, or the application of any provision of, these Terms and Conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or other jurisdiction.

Governing Law

These Terms and Conditions are governed by the laws of Western Australia. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Western Australia.

Transferability

Membership, and the rights of being a CCIWA Member, are personal to the member and are not transferable.
