Course Description

A tender cannot be accurately priced without a clear understanding of the proposed contract. Contract terms can materially affect project costs, timelines, payment, risk and overall commercial outcomes.

Designed for commercial managers, contract managers, project managers, key account managers, estimators and senior operational personnel, this course provides practical guidance on identifying, assessing and managing contractual risks throughout the contract lifecycle.

Participants will explore how to review proposed contract terms before execution, align contractual obligations with pricing and project delivery, and prioritise qualifications and departures. This course will also address the consistent administration of contractual rights and obligations

Covering the tender, negotiation, delivery and close-out stages, the course will assist participants to recognise where material risk may arise, preserve contractual entitlement and identify matters requiring timely escalation.

The course will be delivered by Legal Director Cass Wright, who has more than 20 years’ experience as a lawyer and significant experience advising on and supporting commercial tender processes. Cass brings a practical, commercially focused perspective to identifying contractual risk, negotiating contract terms and translating agreed risk allocations into effective project delivery.

  • Understand how contract terms can affect price, programme and project delivery.
  • Identify key risks and obligations when reviewing proposed contract terms.
  • Prioritise commercial qualifications and departures.
  • Identify issues requiring escalation and understand the importance of maintaining appropriate records.
  • Recognise key contractual considerations, including scope of work, time, payment, security, liability, damages and dispute resolution.
