Privacy Act Collection Notice

Businesses regulated by the Privacy Act 1988 (Cth) and the Australian Privacy Principles must be transparent about how they collect, use and disclose Personal Information.

This commonly includes businesses with annual turnover of more than $3 million, as well as certain other businesses regardless of turnover, depending on the nature of their activities.

Business Law WA’s Privacy Act Collection Notice is designed to help organisations clearly explain, at the point of collection, how Personal Information is collected, used and disclosed.

The template is drafted for practical use in commercial and workplace environments and can be customised to address:

  1. what Personal Information is collected and why;
  2. whether Sensitive Information is collected and the basis for collection;
  3. how Personal Information is collected, used and disclosed;
  4. whether collection is required or authorised by law;
  5. the consequences if Personal Information is not provided;
  6. whether Personal Information is likely to be disclosed overseas;
  7. how individuals can access or correct their Personal Information;
  8. how privacy complaints may be made and handled; and
  9. where individuals can access the organisation’s Privacy Policy and privacy contact details.

Business Law WA can assist with tailoring the Collection Notice to your business’s operations, legal obligations and information-handling practices. Please contact the Commercial Legal Team.
